By accessing or using lunarwebstudio.com (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use this Site.

These Terms apply to all visitors, inquiry submitters, and clients. Where a separate written service agreement exists between Lunar Web Studio LLC and a client, that agreement governs the client engagement; these Terms govern general site use.

2. Services Description

Lunar Web Studio LLC provides web design, web development, SEO, e-commerce, and related digital services to businesses and individuals worldwide. Specific deliverables, timelines, and fees are defined in individual project agreements or proposals provided to each client.

Submitting a consultation inquiry does not create a binding contract or guarantee that we will accept your project. We reserve the right to decline any engagement at our discretion.

3. Use of This Website

You agree to use this Site only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use the Site in any way that violates applicable local, national, or international law or regulation.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Attempt to gain unauthorized access to any part of the Site or its related systems.
• Engage in any conduct that restricts or inhibits anyone else's use or enjoyment of the Site.
• Submit false or misleading information through our consultation form.

4. Intellectual Property

All content on this Site (including text, graphics, logos, images, and code) is the property of Lunar Web Studio LLC or its content suppliers and is protected by applicable intellectual property laws.

You may view and print pages from this Site for personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.

Work featured on the portfolio page is either a product Lunar Web Studio LLC designed, built, and operates itself, or a demo build produced to show our capability. Demo businesses shown there are fictional. Where client work is featured in future, it will appear with that client’s permission, and client-owned deliverables remain the property of the respective clients per their project agreements.

5. Client Agreements

Clients who engage Lunar Web Studio LLC for services will receive a project agreement or statement of work ("SOW") that defines the full scope of the engagement. Key terms typically include:

• Scope: Defined deliverables and revision rounds.
• Timeline: Estimated project milestones and delivery dates.
• Fees: Total project cost and payment schedule.
• Ownership: Transfer of final deliverables upon receipt of full payment.
• Confidentiality: Protection of sensitive business information shared during the project.

The signed project agreement takes precedence over these Terms for all matters related to the client engagement.

6. Payments and Fees

Payment terms are outlined in the project agreement or proposal provided to each client. In general:

• The project fee is a fixed total, divided into six equal monthly payments.
• The first and sixth payments are due together before work begins; the remaining four are invoiced one a month.
• The monthly payments are a schedule for a fixed fee, not a subscription: the full fee is owed for the work described in the agreement whatever date the site launches.
• The payment schedule is not the project schedule. Sites are normally launched within weeks of the project starting, well before the sixth payment; launching early neither accelerates the remaining payments nor adds a charge.
• Hosting and minor updates are included for those six months. From month seven, ongoing hosting or a care plan is billed monthly at the rate the client selects.
• Overdue invoices may incur a late fee as specified in the project agreement.
• Work may be suspended on an account more than 15 days past due, and a hosted site may be taken offline on an account more than 30 days past due, in each case after written notice. A site taken offline is restored within one business day of payment; content and backups are retained meanwhile, and the client's domain and email are never affected.
• Refund eligibility is governed by the individual project agreement. The two payments due at signing are non-refundable.

7. Disclaimer of Warranties

This Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Lunar Web Studio LLC and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Site or our services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from your use of this Site shall not exceed the amount you paid us for services in the three months preceding the claim, or $100, whichever is greater.

9. Third-Party Links and Services

This Site may link to third-party websites or reference third-party services. We do not control, endorse, or take responsibility for any third-party content, products, or privacy practices. Visiting any linked site is at your own risk.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Travis County, Texas.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. Continued use of the Site following any changes constitutes your acceptance of the new Terms.
